Wismettac Asian Foods Hit with California Labor Law Class Action
Attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, based in Los Angeles, have initiated a class action lawsuit claiming that Wismettac Asian Foods, Inc. breached provisions of the California Labor Code. The case, filed as No. 26STCV06255, is currently under review in the Los Angeles County Superior Court, State of California. The full complaint is available for review online.

Under California labor laws, employers must compensate workers for every hour worked, including any time employees remain under the employer’s control or are allowed to perform duties. The lawsuit alleges that Wismettac Asian Foods, Inc. required employees to work off the clock without proper compensation. Furthermore, if such off-the-clock work did not qualify for overtime pay, the company is accused of failing to provide minimum wage for those hours, in violation of California Labor Code sections 1194, 1197, and 1197.1.

California Labor Code § 226 mandates that employers provide employees with accurate, itemized wage statements. According to the complaint, the plaintiff was paid hourly, meaning their wage statements should clearly show all relevant pay periods in which earnings were accrued, as required under Section 226(a). The lawsuit claims that the wage statements issued by the defendant did not include this required information.
