Employees reportedly earned additional non-discretionary incentive compensation, which should have been factored into their regular rate. Under California Labor Code Section 246, paid sick leave for nonexempt workers must be calculated by dividing total wages—excluding overtime premiums—by total hours worked over the prior 90-day period. The lawsuit alleges that Apria Healthcare LLC did not follow this method.
